Information about using beta features

We are thrilled to have you on board as a beta tester. Using Pre-Released Software comes with some benefits and certain risks. This document highlights everything you need to know, and it is also an agreement between You and Picflow that outlines the legal structure of participating in such a program.

Summary

As with any Beta Program, you will be asked to agree to several conditions before you can get access and begin testing. It is vital for us that you are comfortable with this agreement. Here's a summary of the main terms you'll be agreeing to:

  • You acknowledge that you are participating in a beta program, and the information you get as a tester is confidential.

  • You understand that beta versions can contain bugs and might cause problems.

  • You acknowledge that Picflow can contact you for feedback requests.

  • You allow Picflow to use feedback and suggestions you provide in a gratuitous manner in order to improve the product for all users.

  • You are not a member of the press, nor an employee or representative of any competitor, and you won't disclose your role as a beta tester either.

Benefits

  • You get early access to new features before everyone else, and you can use them for weeks or even months before they are released.

  • Direct channel to the Picflow Team in order to guide the product and the creation of new features in a direction you need.


Risks

Testing an unreleased software comes with risks such as unexpected behaviours and possibly even loss of data/images. By its nature, beta software may contain errors, bugs and other problems that could cause a system failure. The quality assurance and testing may not yet be completed. Here's an overview of some things that might happen during your usage:

  • Unexpected behaviours and bugs in the application

  • Regular updates, changes or removal of existing features

  • Loss of galleries and images as well as loss of client feedback

  • In rare cases, we might also have to reset your account


Agreement

Please read the following agreement to learn more about the obligations of participating in a Beta Program.

Confidentiality

As a beta tester, You'll receive private company information such as insights into the product roadmap, upcoming features and marketing strategies. You agree to keep provided information confidential and not disclose or discuss it with any third party. You represent that neither you nor any household member is an employee or representative of any competitor.

Feedback

You will provide feedback to Picflow regarding the operation or use of the product when it is requested. This may include filing online reports, participating in telephone interviews, maintaining a record of problems or errors, providing suggestions and ideas, and responding to written surveys that may be provided by Picflow. You acknowledge and agree that Picflow may use, disclose, reproduce, license, distribute and otherwise commercialise such feedback. You hereby grant Picflow all required licenses in your feedback and the associated intellectual property rights to allow Picflow to carry out these rights.

Warranties

You acknowledge and agree that: the Beta Product is in development and has not been commercially released by Picflow. The Beta Product may not be fully functional, and it is expected that it will contain errors, design flaws or other problems, including problems that may adversely impact the operation of your existing Products; the Beta Product may not be reliable during the time you are participating as a tester in the Picflow Beta Program; the Beta Product and its use may result in unexpected results, loss of data or other unpredictable damage or loss to you; Picflow is under no obligation to release a commercial version of the Beta Product; Picflow has the right to unilaterally abandon development of the Beta Product at any time and without any obligation or liability to you or any third party. You further acknowledge that you have paid no consideration to Picflow for the Beta Product hereunder and that the Beta Product is being supplied to you "As Is".

Ownership

You acknowledge and agree that Picflow owns all right, title and interest in and to the Beta Product and in any and all intellectual property rights therein, including but not limited to any and all copyrights, patents, patent applications, trade secrets, trademarks and other intangible rights therein. You will not earn or acquire any rights or licenses under any copyrights, patents, trade secrets, trademarks or other intellectual property rights on account of this agreement or your performance under this agreement. You agree to promptly disclose and hereby assign to Picflow any suggestions for change and/or improvement to the Beta Product and any related rights thereto and to assist Picflow, as reasonably requested by Picflow and at Picflow's expense, in obtaining intellectual property protection relating to such suggestions as Picflow may reasonably direct.

Liability

In no event shall Picflow be liable to you or any other party for damages of any kind arising from the use of beta software. The parties agree that the foregoing limitation of liability is material to this agreement.

Privacy

For purposes of this beta test program, you agree to allow Picflow, its employees or agents to contact you using the personal contact information you have provided, such as your name, email, address, and telephone number. Picflow may store or share this personal contact information with Picflow employees in order to communicate with you. Picflow may use, collect, or store information generated from your testing, including image data and analytics used to improve the overall service ("Usage Data"). Picflow may disclose, share, redistribute, or publish such Usage Data. No personal information will be shared ever. Termination

This agreement will automatically expire at the end of your participation as a Picflow Beta tester. Either party may terminate this agreement for any reason or no reason by both parties. This agreement will automatically terminate upon any breach by you of any of your obligations hereunder, including breach of confidentiality obligations. Your violation of any of your obligations under the agreement may result in your immediate removal from the Picflow Beta Program.

Changes

We encourage you to periodically review this page for the latest information on the policy. Your continued participation in this Beta Program constitutes your agreement to be bound by such changes to this policy.
